AGREEMENT TO TERMS
We are Salvatore Castellitti, doing business as Caste.dev ("Company," "we," "us," "our"), a company registered in Italy at Via Sannio 1, Petrella Tifernina, Molise 86024.
We operate the website Tailor DM (the "Site"), as well as any other related products and services within the FounderFitted suite that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services"). The Services provide AI-powered video editing, content generation, and messaging tools through our various features including Viral Clone, Bulk Clippers, Director Mode, and StitchPost.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Salvatore Castellitti, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
The Services are intended for individuals who are at least 13 years old (or 16 where required by local law). Do not use the Services if you are under this age threshold.
Tailor DM provides AI-powered tools for content creation, video manipulation, and messaging. The Services involve processing user input text, video, and data to facilitate automated interactions and media generation. We utilize artificial intelligence technologies to generate and manipulate images, videos, and text across our features (Viral Clone, Bulk Clippers, Director Mode, and others). We do not explicitly state which specific AI models or underlying providers are used, and this may change at any time to ensure the best performance and quality.
We use Supabase for data storage, user authentication, and database management. We use Polar for subscription billing and payment processing.
Our Rights: We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein.
User Representation of Rights: By using features like Viral Clone, Bulk Clippers, and Director Mode, you expressly represent and warrant that you hold all necessary rights, licenses, consents, and permissions for the videos you upload or the YouTube channels you search and process through our Services. You agree not to upload or analyze content for which you do not hold the appropriate rights.
Viral Clone Visibility & Deletion: Any video that you upload specifically for use within the Viral Clone feature will be publicly accessible for necessary processing and viewing. These videos are subject to automated deletion and are scheduled to be deleted on a weekly basis from our servers.
To access certain features of the Services, you must create a login account. When creating an account, you agree to provide accurate, current, and complete information and to maintain the security of your password and account. You are responsible for all activities that occur under your account. We use Supabase for user authentication and account management.
Billing and Renewal: We offer paid subscriptions and credit packages to unlock specific features and generation capabilities. Payments and subscriptions are managed securely through Polar. You consent to recurring charges (if applicable to your plan) until you cancel through your account settings or the Polar customer portal.
Cancellation: You may cancel your subscription at any time. Your cancellation will take effect at the end of the current paid term.
By subscribing to our Services or purchasing credits, you acknowledge and agree that all purchases are non-refundable. We do not offer refunds, credits, or pro-rated billing for canceled subscriptions, partial billing periods, or unused services.
Please ensure that the service meets your needs before purchasing. You may cancel your subscription at any time to prevent future charges, but no refunds will be issued for charges already incurred.
Our feature StitchPost uses the third-party service upload-post (available at upload-post.com) to handle specific functionalities. All rights related to the upload-post service are reserved to them.
Keep in mind that when using StitchPost, you are also bound by the terms of use of upload-post. Please see their terms of usage for more information.
By using our provided affiliate link to access or sign up for upload-post, you help support the continuous improvement of Tailor DM and the FounderFitted suite.
USE AT YOUR OWN RISK. Our Services may provide tools that allow you to automate interactions, generate media, and post to third-party platforms. You acknowledge that using automation tools or posting AI-generated content may violate the Terms of Service of these third-party platforms (e.g., TikTok, YouTube, Instagram, X/Twitter, LinkedIn, etc.).
We take absolutely no responsibility or liability for any improper usage of the generated content, nor for any actions taken by third-party platforms against your account(s), including but not limited to: shadowbans, temporary or permanent suspensions, bans, termination, or loss of access to data, followers, or reputation.
You are solely responsible for ensuring your use of our Services complies with all applicable third-party terms and community guidelines, as well as local laws. By using our Services, you agree to indemnify and hold harmless Salvatore Castellitti, Caste.dev, and Tailor DM from any claims, damages, or losses arising from your use of the Services or any restrictions imposed on your accounts by third parties.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Legal Terms, abuse of the platform, or at our sole discretion.
You have the right to request the deletion of your account and all associated data at any time. Account and data deletion processes, including the removal of your data from our active databases on Supabase, take up to 1 week (7 days). Please note that some data may be retained for longer periods as required by law or for legitimate business purposes.
These Legal Terms are governed by and interpreted following the laws of Italy, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. Salvatore Castellitti and yourself both agree to submit to the non-exclusive jurisdiction of the courts of Italy.
Any dispute arising from the relationships between the Parties to these Legal Terms shall be determined by one arbitrator who will be chosen in accordance with the Arbitration and Internal Rules of the European Court of Arbitration having its seat in Strasbourg. The seat of arbitration shall be Campobasso, Italy. The language of the proceedings shall be Italian. Applicable rules of substantive law shall be the law of Italy.
